The Buckley’s Bad Taste Tour (the "Contest") is sponsored by The Buckley's Company (the "Sponsor").

How to Enter

From Thursday November 22, 2007 until 11:59pm Sunday April 27th 2008, the Sponsor will conduct product sampling of Buckley’s Mixture (“Buckley’s”) at various locations across Canada, including but not limited to ski hills, hockey arenas and shopping malls. Individuals, except in Quebec, will be given the opportunity to become participants in the Contest. Upon completing and signing a Medical Release, participants will be given a spoon full of Buckley's to swallow and their reactions will be captured on digital camera. The photos of participants’ reactions will be posted at www.badtastetour.ca (the “Contest Website”). The Sponsor will have the sole discretion to determine which photos may be posted.

Eligibility

Contest open to residents of a Canadian province other than Quebec, who are 12 years of age or older and have parental consent unless they are the age of majority in their province of residence. Employees, directors and officers, representatives and agents of the Sponsor, its affiliate member-companies and their respective subsidiaries and affiliates, and anyone domiciled with such persons, are ineligible.

To be declared the winner, the selected entrant must be eligible to work in Canada.

Selected Entrant

On or about June 28, 2008 (the “Selection Date”), the Sponsor will select one entrant from among all entries posted on the Contest Website. Members of the general public will be eligible to vote for their favourite entrant on-line at the Contest Website during the Public Voting Period in accordance with the process set forth therein (the “Public Voting Process”). Individuals may vote as often as they wish. The Sponsor will consult the results of the Public Voting Process but is not obliged to accept such results and reserves the right, in its sole discretion, to determine the selected entrant. Where the integrity of the Public Voting Process is compromised or not functioning, as determined by the Sponsor in its sole discretion, the Sponsor may cancel the Public Voting Process. The Sponsor will base its selection on the number of votes received and on any other factors that the Sponsor deems appropriate, such as conveyance of a suitable and memorable reaction and overall impression.

Prize

One (1) entrant will be selected to appear in a Buckley’s advertisement and receive a five-year supply of Buckley’s (the “Prize”). The approximate retail value of the five-year supply of Buckley’s is $500. The compensation for appearing in a Buckley’s advertisement will depend on the manner and content of the advertisement and corresponding industry standards.

Prize must be accepted as awarded, is not redeemable for cash, and no substitution of Prize is permitted. Sponsor reserves the right to substitute a prize of equal or greater value in the Sponsor’s sole discretion. Arrangements will be made for the Buckley’s to be delivered to the declared winner’s Canadian address at the Sponsor’s expense.

The odds of being selected to receive the Prize will depend on the number of entries posted and on votes received.

Additional Conditions

The selected entrant will be notified by mail within 10 days of the Selection Date. To be declared the winner, the selected entrant will be required, within 14 days of receipt of notification, to complete, sign and return documentation regarding: (a) confirmation of eligibility; (b) release of the Sponsor from liability; (c) consent to publicity; (d) consent to compliance, at the Sponsor’s expense, with any requirements of the actor’s guild, ACTRA, to participate in any Sponsor promotions; and (e) any other related matter as deemed appropriate by the Sponsor in its absolute discretion, along with a correctly answered mathematical skill-testing question. Failure to fully comply with these conditions may, in the absolute discretion of the Sponsor, result in forfeiture of the Prize and selection of an alternate entrant.

By participating in the Contest, you grant the Sponsor and its agents the full right, without compensation or limitation, to reproduce, publish, exhibit or otherwise use your photograph, likeness, comments and first and last name and city of residence (collectively, your “Entry”), for any type of advertising, promotion or communication, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, unless prohibited by law. You understand that your Entry may be posted online and voted on by visitors to the Contest Website.

Sponsor not responsible for lost, late, stolen, incomplete, illegible, garbled, misdirected, mutilated or inaccurate entries or votes, for any human or technical errors, including failed network connections, errors in relation to the performance or administration of the Contest Website, any problems, including the failure to have cookies enabled, or mechanical or technical malfunction of, or damage to, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software, failure of any email or entry to be received by any party for any reason, including mechanical or technical problems or traffic congestion on the Internet or at any website, or any combination thereof, for damage to an entrant's or any other person's computer or for breaches of privacy due to interference by third party computer "hackers", or for any entries or votes deemed irregular by the Sponsor in its sole discretion.

All entries become the property of the Sponsor and will not be returned. Limit of one entry per individual; duplicate entries may lead to complete elimination from the Contest. Void where prohibited. Sponsor reserves the right to cancel or modify the Contest at any time if, in its sole discretion, it determines that the Contest is not capable of running as originally planned, or if fraud or any other occurrence compromises the integrity of the Contest. If, as a result of error relating to the entry or voting process or any other aspect of the Contest, there are more potential winners of the Prize than contemplated in the Contest Rules, there will be a random draw amongst all eligible prize claimants to award the correct number of prizes.

Any attempt to damage the Contest Website or to undermine the legitimate operation of the Contest may be a violation of criminal and civil laws, and should an attempt be made to do so, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution and/or ban and/or disqualify an entrant from this and future promotions by the Sponsor.

Entrants agree to release and indemnify and hold harmless all employees, directors, officers, representatives and agents of Sponsor and its subsidiaries and affiliates (the “Releasees”) from any claim, loss, expense (including legal fees) or other liability of any kind which may be sustained in connection with the Contest, including, without limitation, any damages resulting from the acceptance, possession, use or misuse of the Prize. The Releasees shall not be liable to the declared winner of the Prize for any guarantee, warranty, condition or representation, express or implied, relating to the Prize, including, without limitation, its quality, condition or fitness for a particular purpose.

By participating in the Contest you agree to be bound by the decisions of the Sponsor, which shall be binding and final with respect to all aspects of the Contest. The Contest is governed by the laws of Ontario and the laws of Canada applicable therein.
